A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

피고인은 2015. 1. 30. 경 평소 V 라는 친구를 통해 알고 지내던 소위 ‘ 보이스 피 싱’ 조직원인 C으로부터 보이스 피 싱 범행에 사용되는 대포 통장에서 현금을 인출하여 전달해 주면 수고비로 인출한 금액의 일부를 주겠다는 제안을 받아 이에 응하여, 중국의 채팅 어 플 리 케이 션인 ‘ 위 챗 ’에서 ‘E’, ‘W’, ‘X’ 아이 디를 사용하는 보이스 피 싱 조직원들이 불상의 방법으로 알아 낸 피해자의 금융거래정보로 피해자의 계좌에서 대포 통장으로 금원을 이체하면, 위 C과 C으로부터 소개를 받은 다른 보이스 피 싱 조직원인 D와 함께 위 ‘E’ 등의 아이디를 사용하는 보이스 피 싱 조직원들의 지시에 따라 현금카드로 피해 금원을 인출하기로 하였다.

On January 31, 2015, the Minister of Justice: (a) obtained the right to access the said account by ascertaining the financial transaction information, such as the Nong Bank (L) number, password, Internet banking password, etc. of the victim K in an irregular manner; and (b) 6,050,000 won from the said Nong Bank account of the victim through Internet banking to the Nong Bank (Z) account in the name of Y around 03:18 of the same day; (c) 6,080,000 won from around 03:18 of the same day; and (d) 6,120,000 won from around 03:32 of the same day to the company bank account in the name of AC (AB); and (d) the Defendant and C, along with D, from around 203:38, 2015 to the same year.

2. 1. At around 00:19, the Plaintiff withdrawn the said money by going back to the new bank dong branch located in Yeongdeungpo-gu Seoul Metropolitan Government, to the Korean bank franchising branch, and to the training branch located in Seocho-gu Seoul Metropolitan Government, and to the training branch located in the Yeonsu-gu, Incheon, as the Korean National Bank is located in Seocho-gu.

Accordingly, the defendant acquired property benefits of 18,250,000 won by making data input without authority into a computer or other information processing device in collusion with C, D, and non-name data processing staff.
