Reasons
Punishment of the crime
The defendant is the representative of the Heung-gu Co., Ltd., Ltd., Ltd., located in Yeongdeungpo-gu, who employs eight full-time workers and operates a motor vehicle repair service business.
From September 14, 201 to February 15, 2014, the Defendant, while serving in the said workplace, did not pay 471,870 won of wages and 9,289,150 won of retirement pay on September 14, 2013, and 22,523,220 won of total wages of 85,302,254 of employees and four retirement allowances of 22,523,220 won of employees, respectively, within 14 days from the date of retirement, as stated in the list of crimes in the attached Table.

1. Application of Acts and subordinate statutes governing registration;

1. Articles 40 and 50 of the Criminal Act of the Commercial Competition;
1. Selection of imprisonment with prison labor chosen;

The sentence shall be rendered as ordered, taking into account the grounds for sentencing under the former part of Article 37 of the Criminal Act, Article 38(1)2, and Article 50 of the Act on the Aggravated Punishment of Concurrent Crimes, the background leading up to the delay in payment of wages and retirement allowances by the defendant, the amount of unpaid wages and retirement allowances by the defendant, the defendant's previous conviction relation (one time before this type of fine), and all other conditions of sentencing as shown in the records
