A defendant shall be punished by imprisonment for one year.

Of the facts charged of this case, the prosecution against intimidation is dismissed.

Punishment of the crime

The Defendant, “2020 Go-Ma39,” was married to the victim B (the age of 59) and the 1990, and was living separately from 2016. From October 22, 2019 to October 17, 2019, the divorce procedure was in progress at the Jeju District Court, or upon the Defendant’s request, temporarily resided in the C Apartment D at Jeju, which is the victim B’s residence.

1. Around 11:00 on November 26, 2019, the Defendant: (a) committed assault against the victim on the ground that the Defendant frequently performed drinking alcohol; (b) the Defendant changed the password of the entrance of the said residence; and (c) the victim B (the age of 59) went to a dispute; and (d) took a dangerous object in his/her dwelling room, and (e) took the chair of the said dangerous object, which was in danger of being in his/her dwelling, and did assault the victim at one time by taking advantage of the victim’s left side, etc.

2. Around December 31, 2019, the Defendant threatened the victim by having the victim E (here, 20 years of age) who is his/her daughter and his/her wife with money problems, while having been doing a dispute with his/her wife as a matter of money, the Defendant brought him/her to his/her hand the knife (30 cm in total length, 20 cm in length on the day, and 20 cm in length) which is a dangerous object in the bank and was in his/her possession, and saying that he/she would be dead.

3. After having the same day as described in paragraph (2), the Defendant was demanded to leave from the victim B to leave the above residential area on December 31, 2019.

Nevertheless, at around 23:44 on the same day, the Defendant entered the C Apartment Fdong in Jeju City, with the first floor door, intruded the door of the Dho Lake that the victim B resides in through the stairs, and then called “as soon as possible, opening the gate, and opening the gate,” and read as “induction of the inside money,” thereby opening the first class bell in several times, and intending to enter the victim’s residence at hand.
