The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal is consistent from the investigative agency to the court of the court below that the defendant was assaulted as stated in the facts charged in the judgment below, and there is sufficient credibility of the statement, and field photographs also conform to the victim's statement. Thus, the judgment of the court below that rejected the credibility of the E statement and acquitted the defendant, which affected the conclusion of the judgment, is erroneous.

2. Determination

A.
