A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

At around 03:00 on June 10, 2017, the Defendant discovered the Victim K (V, 21 years old) who was drunk in the vicinity of the “J club” located in Mapo-gu Seoul Metropolitan Government, and tried to meet the sexual desire against the victim under the influence of alcohol to the extent that he is unable to overcoming his body.

1. On June 10, 2017, at around 03:50, the Defendant infringed upon a structure: (a) around the “N” restaurant operated by the victim M in Mapo-gu Seoul Mapo-gu, Seoul; (b) caused the said restaurant to break up the female for the purpose of rapeing the said victim’s K by using the gaps in which the surveillance of the victim was neglected; and (c) caused the damage to the structure managed by the victim’s M.

2. A property damage Defendant: (a) around 04:17 on the same day, in order to avoid raping the victim K in N, the victim M-owned partitions installed at the same time were knifeed by hand, and damaged the mobile partitions of approximately KRW 200,000 in the market price by tearing it.

3. Quasi-rape;

A. The Defendant 1 committed an indecent act at the time and time set forth in the above paragraph 1, and at the same time, committed an indecent act, such as: (a) the victim’s knife knife knife knife knife knife knife knife into the floor; (b) the victim’s knife knife knife and knife knife knife knife knife knife knife into the floor; (c) the victim’s knife knife knife knife knife knife knife knife knife knife knife knife knife knife knife

B. The Defendant, at around 08:00 on the same day, was raped in Seoul Mapo-gu, Seoul Mapo-gu, 302, and went into the victim K, which had yet to unsatisfy in drinking, and went into the telecom, and went out of the victim K’s clothes in a state of resistance by drinking the following alcohol.
