그러나 이 사건 범행은 피고인이 한밤중에 지인의 집에서 잠을 자던 나이 어린 피해자를 음부를 만지고 핥는 등의 방법으로 강제로 추행한 것으로 그 죄질이 매우 불량하고 추행의 정도 또한 가볍지 아니한 점, 피고인은 이전에도 범죄에 취약한 아동 또는 청소년을 대상으로 성폭력범죄를 저지른 전력이 있음에도 성폭력범죄로 인한 형의 집행 종료 후 그 누범기간 중에 또 다시 이 사건 범행을 저지른 점, 이 사건 범행으로 피해자는 큰 정신적 충격을 받았고 장래 건전한 성관념 형성 등 정상적인 성장에도 나쁜 영향을 받을 수 있는 점, 그럼에도 아직 별다른 피해회복이 이루어지지 않았고 피해자 측으로부터 용서받지 못한 점 등의 불리한 양형요소 또한 인정된다.

In full view of the aforementioned factors of sentencing and the Defendant’s age, character and conduct, intelligence and environment, criminal records, motive and background leading to the instant crime, means and consequence of the instant crime, and various circumstances revealed in pleadings, such as the circumstances after the commission of the crime, the sentence sentenced by the first instance court is deemed appropriate, and it is too unreasonable.

Therefore, the defendant's assertion is without merit.

B. As to the part of the case for which the attachment order was requested, the first instance court ordered the Defendant to attach an electronic tracking device for seven years, and simultaneously imposed the following matters to be observed.
