The prosecution of this case is dismissed.

1. On August 27, 2012, around 08:45, the Defendant committed an indecent act on the part of the victim by using the gap that is attached to the victim D (Inn, 29 years of age) and then making the Defendant’s sexual flag that was caused by the Defendant’s sexual flag attached thereto, which is located after the victim D (inn, 29 years of age), located in the subway 9 line located in Yeongdeungpo-dong, Yeongdeungpo-gu, Seoul Metropolitan Government, as a part of the fact-finding on August 27, 2012.

2. In light of the judgment, the above crime is a crime falling under Article 11 of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes and can be prosecuted only upon a complaint under Article 15 of the same Act. According to the records of this case, the victim can recognize the fact that the complaint against the defendant was withdrawn after the prosecution of this case. Thus, the prosecution of this case is dismissed pursuant to Article 327 subparagraph 5
