A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal history] On January 18, 2008, the Defendant was issued a summary order of KRW 1.5 million for a crime of violating the Road Traffic Act (drinking driving) at the Seo-gu District Court Branch Branch of the Daegu District Court on January 18, 2008, and a fine of KRW 2.5 million for the same crime at the same court on June 29, 2010.

[2] On July 16, 2020, at around 02:55, the Defendant driven D Launa car about 10cc under the influence of alcohol concentration of 0.147% in blood on the front road located in Daegu Northern-gu B.

Accordingly, the Defendant violated the prohibition of drinking alcohol driving more than twice.

1. Inquiries about the results of crackdown on the driving of drinking and the statement in the circumstances of the driver;

On-site photographs and photographs of measuring instruments (the concept of driving includes any objective element in light of the content of the regulation, so it means only the act of driving, and it does not constitute driving in the case of driving a motor vehicle without any intention or involvement of a person in the motor vehicle.

따라서 어떤 사람이 자동차를 움직이게 할 의도 없이 다른 목적을 위하여 자동차의 시동을 걸었는데, 실수로 기어 등 자동차의 발진에 필요한 장치를 건드려 원동기의 추진력에 의하여 자동차가 움직이거나 또는 불안전한 주차상태나 도로 여건 등으로 인하여 자동차가 움직이게 된 경우는 자동차의 운전에 해당하지 아니한다( 대법원 2004. 4. 23. 선고 2004도 1109 판결 등) 위 각 증거들에 따르면, 피고인은 차량의 시동을 켠 상태에서 운전석에 앉아 담배를 피 던 도중, 후진 등이 켜진 사실, 이후 차량이 2번 느린 속도로 후진한 사실, 후진할 당시에는 붉은 브레이크 등이 약해 졌다가, 다시 브레이크 등이 강해 진 후 곧 후진 등이 꺼진 사실을 인정할 수 있다.
