The defendant shall receive KRW 66,00,000 from the plaintiff, and at the same time, the building listed in the attached Table shall be the plaintiff.
Reasons
1. Facts of recognition;
A. A. A lease contract between C and the Defendant (hereinafter “instant lease contract”) was entered into between C and the Defendant with the National Housing Fund’s support in around 2010 and the rental business operator who constructed and leases E apartment units, which are publicly constructed rental housing units, in Busan-gun, Busan-gun; (2) on October 27, 2010, C and the Defendant selected as the occupant on the first-come first-served basis, entered into a lease contract with the Defendant as to E apartment F (attached Form; hereinafter “instant apartment”) with the lease deposit amount of KRW 66,00,000, monthly rent of KRW 150,000, and five years from the date of designation of the lease term of the lease (hereinafter “instant lease contract”). At that time, the Defendant paid KRW 66,00,000,000 to C.
3) According to the instant lease agreement, the lessee is the former Rental Housing Act (wholly amended by Act No. 13499, Aug. 28, 2015; hereinafter “former Rental Housing Act”).
(2) The lessee of a rental house under Article 19 of the former Rental Housing Act shall not be entitled to transfer the right of lease or sublet the rental house to another person (Article 6(1) of the instant lease agreement); and the lessee of a rental house under Article 19 of the former Rental Housing Act shall transfer the right of lease (including sale, donation and all other acts resulting from the alteration
() No person may transfer or sublease a rental house to another person: Provided, That in cases prescribed by Presidential Decree, where a rental business operator has obtained the consent of the rental business operator, he/she may cancel or terminate the lease contract or refuse to renew the lease contract in violation of subparagraph 4 of Article 10 (1) of the instant lease contract).
