A defendant shall be punished by imprisonment for a term of one year and four months.
Reasons
Punishment of the crime
1. On December 22, 2010, the criminal defendant against the victim C made a false statement to the effect that “A victim C is performing a large number of interior test works, but only once two months have passed.” If the victim borrowed money, he/she would make a repayment within two months with no mold and pay back credit in the past.”
However, in fact, the Defendant had a debt of about 300 million won at the time of bad credit holders, and approximately 170,000 won per day during daily work, and even if he received the above money from the victim, he did not have the intent or ability to repay the borrowed money to the victim.
Nevertheless, on December 22, 2010, the Defendant, by deceiving the victim as above, received KRW 15 million from the victim to the agricultural bank account in the name of F as the borrowed money, and acquired it by deceiving the victim more than four times, such as the statement 1 in the list of crimes in the attached Table 1.
2. Around April 12, 2011, the Defendant against the victim G made a false statement to the effect that “When he/she entrusts the construction of the building of the agricultural and fishery products processing facilities (ware) processing facilities (ware to be newly built in G to G to G to G, he/she will complete the construction without delay within a given period. The value of the material is lower than the value of the material, 5 million won should be deposited before it is deposited and changed.”
However, the Defendant had a debt of about 300 million won at the time of bad credit holder, and only he thought that he had to borrow additional money from the victim without any capital in addition to regular income of about 170,000 won per day while performing daily work, and even if he received the said money from the victim, he did not have the intent or ability to carry out the construction of the said building.
Nevertheless, the defendant deceivings the victim and is on the same day from the victim.
