피고인은 2014. 3. 23. 21:10경 창원시 마산회원구 B에 있는 C 마트 앞 길에서 피고인의 일행들과 소란을 피워, 112신고를 받고 그 곳에 출동한 마산동부경찰서 D파출소 소속 경사 E과 경위 F으로부터 112 신고 관련 조사를 위한 제지를 당하자 위 E, F에게 "야 개새끼들아 니들이 뭐야, 새끼야 니 뭐꼬"라고 말하면서 주먹으로 위 E의 얼굴을 향하여 2회 휘두르고, 왼발로 위 E의 오른쪽 종아리를 2회 걷어차는 등 폭행하였다.
