A defendant shall be punished by imprisonment for not less than eight months.

An applicant for compensation shall be dismissed.

Punishment of the crime

[criminal records] On June 27, 2017, the Defendant was sentenced to a suspended sentence of two years for criminal fraud in the Daegu District Court resident support for the last 2017, and the above judgment became final and conclusive on November 23, 2017.

[Criminal facts]

1. On December 11, 2016, the Defendant posted a false statement of sale that he sells cococococopis on the Internet NAB Kabin’s website. The Defendant reported the false statement to the victim C, who called the victim C, stating that “The remittance of the price for selling the homecopis is demanded.”

However, the defendant did not have a bank, so there was no intention or ability to sell a bank.

The Defendant, as above, received 150,000 won from the injured party as the price for the goods on the same day, and received 739,000 won in total from March 16, 2017 through the same method from March 16, 2017, from that time, as shown in the attached Table 1, as well as from March 16, 2017.

2. On June 2, 2017, the Defendant posted a false statement on the following purport: (a) at the Defendant’s residence located in Daegu Northern-gu D, Daegu Northern-gu, 502; (b) using mobile phones to access the Republic of Korea to NAV carpets; and (c) to the victim E who reported and contacted with the Defendant, stating that “When deposit KRW 200,000,000,000 is to deliver the SDRs.”

However, in fact, the Defendant did not have the above softs at the time, and had the purpose of raising the money to refund to other fraudulent victims, so even if he received the money from the injured party, he did not have any intent or ability to deliver the softs.

The Defendant received 200,000 won from the damaged person to the new bank account in the name of F on the same day.

3. On May 31, 2017, the Defendant: (a) at the residence of the Defendant located in Daegu Northern-gu D, 502; and (b) at the cell phone of the Defendant using a mobile phone.
