The judgment of the court below is reversed.

A defendant shall be punished by imprisonment for not less than two years and six months.

However, for a period of four years from the date this judgment becomes final and conclusive.

1. The sentence imposed by the court below on the defendant (three years of imprisonment) is too unreasonable.

2. The crime of this case in light of the following: (a) the Defendant committed the crime of this case at night, carrying a deadly weapon with him, thereby forcibly taking money and valuables into account the female victim’s residence, which is highly likely to pose a potential danger; and (b) the victim’s mental impulse is deemed to have been considerable; (c) the crime revealed in the background and method of the crime is also inferior; and (d) the Defendant was sentenced to a suspended sentence of imprisonment due to the larceny; and (e) the Defendant had a criminal record of a fine not exceeding seven times; and (e) the Defendant’s liability for the crime of this case cannot be deemed to have been mitigated

However, the defendant submitted a number of objections, and his mother appeals to the defendant's wife while leading the defendant. The crime of this case occurred when the defendant took advantage of his workplace fees, etc. immediately after the crime was committed. Since the defendant's abnormal movement before and after the crime was committed, the defendant was deemed to have committed any contingent crime under the influence of drinking, in view of the defendant's normal control power due to influence of drinking, such as the defendant's failure to go beyond the exercise of his direct tangible power, and the amount of the damaged money and valuables was not significant.
