1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

In addition, there is no evidence to prove the cause of the claim to the Plaintiff as the assignee of the loan claim against the Defendant of the SB Savings Bank, but the Defendant’s defense that the lawsuit in this case was filed and the extinctive prescription has expired after the lapse of five years from the commercial extinctive prescription, and thus, the Plaintiff’s claim in this case is dismissed as it is without merit. It is so decided as per Disposition by the assent of all participating Justices.
