[ 전제사실] 피고인은 분실 내지 도난된 휴대폰을 매입한 후 이를 중국 등으로 밀수출하는 범행을 모의한 후, 보다 많은 양의 장물인 휴대폰을 매입하기 위하여 장물이 많이 나온다는 부산지역에서 속칭 ‘PR( 택시기사들에게 휴대폰 불빛을 깜박이며 장물인 휴대폰 매입의 의사표시를 한 후, 그들 로부터 장물을 매입하는 행위)’ 자리를 선점하기 위하여 평소 폭력조직생활을 하면서 후배를 많이 알고 있는 C, D, E, F 등을 중간 상선으로 고용하였고, C, F은 평소 알고 지내던 후배들을 통해 PR 역할을 할 하선을 모집하였다.
