1. The Defendant: (a) KRW 23,100,000 for the Plaintiff and KRW 6% per annum from July 1, 2015 to November 11, 2015; and (b) for the Plaintiff.
Reasons
1. Indication of claims: It shall be as shown in attached Form; and
2. Judgment without holding any pleadings (Articles 208 (3) 1 and 257 of the Civil Procedure Act);
3. Grounds for partial dismissal: The provisions governing statutory interest rates under the main sentence of Article 3(1) of the Act on Special Cases concerning Expedition, etc. of Legal Proceedings were promulgated on September 25, 2015 and enforced on October 1, 2015.
According to this, from October 1, 2015, the statutory interest rate of 20% per annum was reduced to 15% per annum.
The service date of a duplicate of the complaint in this case is November 10, 2015.
Therefore, since the statutory interest rate applied after the delivery date of a copy of the complaint is 15% per annum, the exceeding part is dismissed.
