The punishment of the accused shall be eight months by imprisonment.

However, the above sentence shall be executed for two years from the date of the final judgment.

Punishment of the crime

On May 13, 2019, the Defendant: (a) heard on May 13, 2019, the term “2019 Highest 1611”, “A party is unable to lend money due to lack of transaction performance; (b) withdrawal of money to increase transaction performance; and (c) change to our employees; and (d) execution of loan 13 million won, by creating a performance record; and (c) he tried to withdraw and deliver money deposited in the Defendant’s account in accordance with the order of the person who has failed to obtain the name, despite recognizing the fact that the said person was willing to use the Defendant’s account to handle illegal money, such as telecommunications-based financial fraud (so-called “mail-based financial fraud”).

A telecommunications-based financial fraud assistance officer in name in the statement refers to a false statement to the effect that “the Government has made a substitute loan to be supported by the Government. However, the amount of the party’s debt is too much so much so that it is not permitted by the Financial Supervisory Service to repay part of it to A’s account. The degree of KRW 5.8 million is to be repaid to A’s account.” The employee received KRW 5.8 million from the victim to the E Association account in the name of the Defendant’s name.

In order to assist the commission of telecommunications-based financial fraud in committing the above fraud, the Defendant, at around 17:45 on the same day, withdrawn the above KRW 5.8 million from the E-Union branch located in Nam-gu, Nam-gu, Dong-gu, in cash, and subsequently, given cash to the male whose name cannot be known from the adjacent street.

Accordingly, the Defendant, by facilitating the fraud of an employee who engages in telecommunications-based financial fraud, such as “C”, was aiding and abetting such fraud.

The defendant of "2019 Highest 1624" on May 13, 2019, the defendant is unable to lend a loan due to lack of transaction performance.

The money shall be withdrawn in order to increase the transaction performance and shall be requested to our employees.
