A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On June 22, 2010, the Defendant entered into a lease agreement with the victim B and Changwon-si C Apartment 2, 310, and 310, and paid 30,000,000 won as the lease deposit to the victim, and paid 30,000,000 won as the remainder individually. Thus, the Korea Land and Housing Corporation may request the Korea Land and Housing Corporation to pay 8,00,000 won as the collateral. Accordingly, the Defendant agreed that the Defendant would pay 38,00,000 won as the lease deposit to the said C Apartment, and the Defendant was directly paid 30,00,000 won as the lease deposit to the victim from the Korea Land and Housing Corporation.

On June 21, 2012, the Defendant made a false statement to the victim at a non-existent place where the above lease term expires to the effect that “new director would have obtained a loan by creating a right to lease on a deposit basis on an apartment. Accordingly, if the deposit is returned, the new director would use the deposit for lease on an apartment, and cancel the right to lease on a deposit basis with the money borrowed by establishing a right to lease on a deposit basis on the apartment. Therefore, the Defendant would not pay the deposit directly to the Korea Land and Housing Corporation, and would return the deposit to him/her.”

However, in fact, the defendant did not obtain the consent from the owner under 14,00, 105, the Sung-gu, Sungwon-gu, Sungwon-si, the new director entered, to obtain a loan by establishing a right to lease on a D apartment. The lease deposit of the above D apartment is merely KRW 15,00,000, and it is difficult to expect to establish a right to lease on a deposit basis for the above D apartment, and it is difficult to expect to establish a right to lease on a deposit basis for the above D apartment as there is no particular property.
