The appeal is dismissed.

The grounds of appeal are examined.

In light of the evidence duly admitted by the court below, the court below is justified in finding the defendant guilty of the charge of this case on the grounds as stated in its reasoning.

In so doing, contrary to the allegations in the grounds of appeal, there were no errors by misapprehending the legal principles regarding the “establishment of a non-medical person” under Article 33(2) of the Medical Service Act or the “establishment of a medical institution” under Article 33(2) of the Medical Service Act, or by misapprehending the legal principles

Therefore, the appeal is dismissed. Since it is apparent that the judgment of the court below was erroneous in the indication, it is decided to correct it in accordance with Article 25(1) of the Regulations on Criminal Procedure. It is so decided as per Disposition by the assent of all participating Justices.
