1. Defendant C and Defendant D jointly and severally are 190,378,780 won and the Appointed Co., Ltd.
Reasons
1. Basic facts
A. (1) Around July 15, 2014, the Defendant Union entered into a contract with Defendant C on the following terms: (a) the Defendant Union contracted to Defendant C for the large-scale repair works of the Daegu Suwon-gu K Hospital located in J (hereinafter “One Corporation”); and (b) the Defendant Union entered into a contract with Defendant C on the following terms:
Article 1 [Terms and Conditions of Construction Works]
1. The name of the construction: the large-scale repair works of K Hospital;
2. Place of construction: Daegu Metropolitan City Suwon-gu J
4. Contract amount: 1,400,000 won (including value-added tax).
6. Advance: 200,000,000 won;
7. Completion portion: once a month.
8. Construction completion amount: 300,000,000 won (2) The Defendant Union and the Defendant C entered into a contract with the following contents, around November 24, 2014, for additional construction works related to the first construction works:
Article 1 [Supplementary Contract for Construction Works]
1. The name of the construction: the large-scale repair works of K Hospital;
2. Place of construction: Daegu Metropolitan City Suwon-gu J
4. Contract amount: 23,700,000 won (including value-added tax); and
8. Construction completion amount: 23,700,000 won (3) Defendant D&C entered into a contract with Defendant C on July 15, 2014 with the following terms: (a) Defendant D&C entered into an agreement with Defendant C to remodel the funeral hall of K Hospital located in the Daegu Suwon-gu J (hereinafter “Second Corporation”).
Article 1 [Terms and Conditions of Construction Works]
1. Construction name: Remodelling works for the funeral hall of the K Hospital;
2. Place of construction: Daegu Metropolitan City Suwon-gu J
4. Contract amount: 480,000 won; and
6. Advance: 100,000,000 won; and
7. Completion portion: once a month.
8. Construction completion amount: 48,00,000 won (4) Defendant C completed the 1 and 2 works.
B. The Plaintiff, etc. entered into a subcontract agreement with Defendant C with respect to the first construction from July 2014 to November 201, as shown in the attached Table 1, and completed the subcontracted construction, but did not receive part of the subcontracted construction cost as stated in the above [Attachment 1].
