A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On February 27, 2012, the Defendant forged private documents: (a) around D loan transaction contract form D in B located in B of the Bupyeong-gun, D; (b) stated “E” in the guarantor’s column, “F” in the resident registration number column, and “E” in the joint and several sureties column; and (c) signed by the name.
As a result, the Defendant, for the purpose of uttering, has forged one copy of a loan transaction agreement in the name of E, a private document on the duty of rights, and from that time the same year.
5. Until March, 500, each forged a private document under E in total five times, such as the list of crimes in the annexed list of crimes.
2. The Defendant, at the time and place specified in the foregoing paragraph (1), issued and used a forged loan transaction contract to D employees who knew of such fact as if they were genuinely formed, and the same year from that time.
5. By March 5, 200, each of the private documents forged over five occasions, such as the list of crimes in the annexed list.
3. The Defendant, at the time and place stated in the above Paragraph 1, delivered a forged loan transaction agreement to the victim D employee, and deceiving the Defendant as if E guarantees the Defendant’s loan obligation.
In this year, the Defendant received KRW 3 million from the victim as a loan from the victim, and the same year from that time.
5. By March 5, 200, a sum of KRW 19 million was received from the victim in total five times as shown in the list of offenses.
4. No person who violates the Resident Registration Act shall unlawfully use another person's resident registration number.
Nevertheless, the Defendant, on February 28, 2012, issued a certificate of acquisition and loss of national health insurance qualification, a certificate of payment of health and long-term care insurance premium, etc. to the customer center of the National Health Insurance Corporation by telephone to the customer center of the National Health Insurance Corporation.
