1. The plaintiff's claim is dismissed.

1. Details of the disposition;

A. On June 9, 2017, the Plaintiff entered the Republic of Korea with tourism and Tong (B-2) status as a foreigner of Egypt nationality, and applied for refugee status to the Defendant on June 21, 2017.

B. On June 27, 2017, the Defendant rendered a decision on the refusal of refugee status (hereinafter “instant disposition”) on the ground that the Plaintiff cannot be deemed as having “a sufficiently-founded fear of persecution” as stipulated in Article 1 of the Convention on the Status of Refugees and Article 1 of the Protocol Relating to the Status of Refugees.

C. On August 3, 2017, the Plaintiff filed an objection with the Minister of Justice on August 3, 2017, but the objection was dismissed on March 21, 2018.

2. Whether the instant disposition is lawful

A. The gist of the Plaintiff’s assertion was that the Plaintiff operated Egypt from Egypt to Egypt from around 2004, but around February 2017, when there was a dispute between the Plaintiff’s friendship and credit problems, the Plaintiff’s relative threatened the Plaintiff with his/her Egypt to go against the terrorist organizations, and notified the Plaintiff of his/her Egypt to the terrorist organizations, and the Plaintiff got a pipe of his/her fear to go away.

Therefore, given that there exists a well-founded fear that the Plaintiff would be subject to gambling when he returns home, the instant disposition that the Plaintiff did not recognize the Plaintiff as a refugee on a different premise is unlawful.

B. 1 The term “refugee” means a foreigner who is unable or does not want to be protected by the country of nationality due to well-founded fear to recognize that he/she is likely to be injured on the grounds of race, religion, nationality, status as a member of a particular social group, or political opinion, or who does not want to return to the country in which he/she had resided before entering the Republic of Korea due to such fear.
