A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On November 14, 2015, the Defendant driven B rocketing car under the influence of alcohol content of about 0.202% in the section of about 1km from the 1km to the road near the Maart-gu, Ansan-si, Annsan-si, Seoul-si, a member of Ansan-si, to the 1stm-gu, Annsan-si.

2. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused before the risk) is a person engaging in driving a rocketing car.

On November 14, 2015, around 02:20, the Defendant driven the said car while under the influence of alcohol and proceeded with the road near the private road in the vicinity of the Sari-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri.

At the time, the lower level of night and the lower level of the surface was unsatisfed, and the lower level of the DNA freight driven by the victim C (54 ) was in progress at the front of the Defendant’s proceeding. In such a case, a person engaged in driving a motor vehicle has a duty of care to safely drive the motor vehicle, such as taking the front and right side well, and maintaining the safety distance.

Nevertheless, the Defendant neglected this and got the back part of the cargo vehicle in front of the Defendant’s car, which was operated by the Defendant in order to pass a speed limit due to negligence in driving.

Ultimately, the Defendant driven the said car in a state where it is difficult to drive the car normally due to influence of drinking, resulting in the Defendant’s injury to the victim, such as light dump dump, which requires treatment for about two weeks.
