Reasons
Punishment of the crime
The defendant is the chairperson of D, an affiliated agency of C, who is an incorporated association, and E is a person who operates "G" in the F of Y.
1. A crime related to the use of a local subsidy for any purpose other than its original purpose is to receive KRW 23,520,000 of the local subsidy from the Jeju-si around January 14, 2015 after filing an application for the grant of a local subsidy with respect to a local subsidy project under the name of "Ycheon-si Civil Service Counseling and Oil Center", and to receive KRW 26,359,000 of the local subsidy from the Incheon-si around January 19, 2016 with respect to a local subsidy project under the name of the same project.
The Defendant faithfully performed a local subsidy project with the care of a good manager in accordance with the details of the relevant local government’s decision to grant subsidies, or the disposition by the head of the relevant local government under the Acts and subordinate statutes, and was prohibited from using the subsidy for purposes other than those prescribed in the relevant local government’s subsidy program, such as moving of the subsidy and providing guidance and assistance to the disabled who have difficulty in social activities. However, around July 12, 2016, the Defendant used KRW 31,000 as fuel expenses for attending the Ho Monthly Funeral Meeting around July 12, 2016 and embezzled the funds of the victim D in the course of business, such as the provision of the disabled vehicle services, etc., by using the fuel expenses of D’s non-official external activities and events, which are not those prescribed in the relevant local government’s subsidy program, such as the provision of the disabled vehicle services, etc., over 11 times in total, and by using the local subsidy for other purposes.
2. On May 13, 2016, the Defendant filed a local subsidy of KRW 5,200,00 with respect to the local subsidy of KRW 4 and monitoring (B230,00 with respect to the local subsidy program with respect to a public official in charge of the YL15-4690K88)’s “purchase of a computer for business purposes of a disabled organization” with respect to a local subsidy program.
