1. The Plaintiff:

A. Defendant B’s KRW 5,00,000 and its related thereto are 5% per annum from September 4, 2011 to October 2, 2015.

1. The description of the grounds for the claim shall be as specified in the attached Form;

Article 208(3)1 of the Civil Procedure Act and Article 257 of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings provides that the Plaintiff shall claim for the payment of damages for delay at the rate of 20% per annum from the day after the copy of the complaint in this case was served to the day of full payment. However, the provision on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings (wholly amended by Presidential Decree No. 26553, Sept. 25, 2015) provides that the statutory interest rate applicable after October 1, 2015 shall be 15 per annum. Thus, the Plaintiff’s claim for damages for delay with 20% per annum from October 3, 2015 to the day of full payment is without merit.
