A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On April 11, 2013, the Defendant sentenced 4 months to imprisonment for night intrusion larceny in the Gwangju District Court's order, 2 years from imprisonment for habitual special larceny in the same court on June 12, 2015, 1 year from imprisonment for the same court on November 29, 2017, and 1 year and 2 months from imprisonment for the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) in the same court on July 25, 2019, respectively.

On August 27, 2020, the Defendant committed a theft of fishing articles, etc. stored in a ship which was anchored at the port of the Seocho-gu, Doyang-gu, Doyang-gun, Doyang-gu, Doyang-do, Seoul, with a view to stealinging the fishing articles.

1. The Defendant, on August 27, 2020, invaded the victim B, who was anchored in the above place, in front of the victim B, and attempted to steal the property owned by the victim, but did not commit an attempted crime without any stolen goods.

2. The Defendant, around 03:25 on the same day, committed the crime against the victim D, who was anchored at the left side of the above C, intruded into the victim’s resting room in front of E, and attempted to steals the property owned by the victim, but did not commit an attempted crime without any goods to be stolen.

3. At around 03:27 on the same day, the Defendant committed the crime against the victim F, who was at anchor in the left side of the above E, and committed a theft of the lock-out system of the steering house entrance by draber, which was in custody in the passenger resting room, by intrusion into the draber, thereby bringing 3,00,000 won of the market price owned by the victim.

Therefore, even though the defendant was sentenced to imprisonment not less than three times due to larceny, the defendant invadedd on a vessel at night during the period of repeated crime, and attempted to steals another's property and attempted to steals over two occasions.
