A As the representative director of the B Co., Ltd. located in Jung-Eup-si, he is a person in charge of safety and health management who actually controls and manages the safety and health affairs of 87 workers, and Defendant B Co., Ltd. is a business owner who conducts the manufacturing of steel or non-metallic metal products using the above workers.

1. Defendant A

(a) A business owner violating the Industrial Safety and Health Act related to death of workers E shall install a safe passage to be used by a person who works in the workplace or in the workplace, keep it available at all times, and (2) prepare a work plan in the case of the work of using vehicle meters and have him/her perform the work in accordance with the plan; and (3) In the case of the work by using vehicle meters, no worker shall enter the place where the vehicle's construction machinery in operation is in contact with the vehicle's construction machinery in question, except for the placement of an guide and the inducement of the relevant vehicle's construction machinery;

Nevertheless, on August 11, 2015, the Defendant did not install a safe passage to be used by the employee in the skid, and the Defendant did not prepare a work plan by using the vehicle-based construction machinery (skid). ③ In the course of performing the work by using the vehicle-based construction machinery (skids), the Defendant was contacted with the vehicle-based construction machinery (skids) and did not place guidances at the place where the workers might face face, and as a result, the Defendant did not prohibit the employee’s entry.

(b) A business owner in violation of the Industrial Safety and Health Act shall install a separate entrance for pedestrians at the entrance of loading and unloading machinery to the entrance of loading and unloading machinery where the main purpose is to install an entrance in the workplace, and 2) the passage of a bridge.
