피고인은 2014. 12. 30. 01:45경 안산시 단원구 C에 있는 ‘D’ 앞 노상에서 그곳 파라솔 의자에 앉아 서로 이야기를 나누고 있는 피해자 E과 피해자 F를 보고 다가가 “어이 예쁜 언니들, 안 들어가고 뭐해 나랑 한번 놀아볼래.”라고 말하였으나 피해자 E이 “할아버지 술 드셨으면 그냥 가세요.”라고 말하였음에도 이를 무시한 채 손으로 피해자 E의 머리와 어깨를 수회 쓰다듬다가 갑자기 “보지가 그리웠다. 내가 너희들 보지 빤다.”라고 말하면서 피해자 E의 왼쪽 가슴을 손등으로 1회 치고, 이를 제지하는 피해자 F의 왼쪽 가슴을 손등으로 1회 치는 등 피해자들을 강제로 각각 추행하였다.
