A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
On December 15, 2009, the Defendant appealed from the Seoul Central District Court, who was sentenced to one year and two months for the obstruction of performance of official duties, and was released from the Seoul Detention Center on March 21, 2010 during the appellate trial, and the said judgment became final and conclusive on February 24, 201.
1. On December 3, 201, at around 22:10 on December 3, 201, the Defendant: (a) expressed that, in the E-mail vehicle operated by the victim D in the front of Jongno-gu Seoul Metropolitan City, the Defendant would not engage in funeral services for the victim who was deemed not to have partially known the lower flyfly value; and (b) during the Defendant’s trial, the Defendant expressed that, “I would not engage in funeral services for the period of e-mail, tax guidance, and funeral service for the victim’s packing horse.”
In addition, it was possible for customers who had been placed on the top of the front package and walked several times to get out of the front package.
Accordingly, the defendant interfered with the victim's packing horse business for about 10 minutes by force.
2. At the time and place specified in Paragraph 1, the Defendant: (a) committed assault to the Defendant, where the victim F was frighted, “I do not spher it off;” and (b) obstructed the Defendant; (c) frightened, “I am fright,” and frightened the victim’s hand; and (d) when the victim frighted the Defendant’s hand, I am boomed the victim’s hand, and assaulted the victim at approximately 100 meters up to the G police box.
3. The Defendant obstruction of the performance of official duties: (a) at the G box located in Jongno-gu Seoul, Jongno-gu, the Defendant: (b) while she saw F to F, who was towing the police box, such as “non-furning fes”, and she took the clothes on the left part of the Defendant’s left part in the lower part of the Roro police station; (c) she felbows down two times following the Defendant’s left part belbow; (d) once again she felbows on the left part of the Defendant’s chest; and (e) she flabs on the police officer inside the police box, who was carrying the police box one time and flabed on the part of the Defendant’s chest.
