1. The plaintiff's claim is dismissed.

1. Details of the disposition;

A. On April 10, 2008, the Plaintiff registered the establishment of a brokerage office with the trade name of “C Licensed Real Estate Agent Office” (hereinafter “instant brokerage office”) using the 1st floor of the building in Osan City as its seat.

B. On April 8, 2014, the Defendant revoked the registration of establishment of the instant brokerage office (hereinafter “instant disposition”) pursuant to Articles 19(1) and 38(1)6 of the Business Affairs of Licensed Real Estate Agents and Report of Real Estate Transactions Act on the ground that the Plaintiff had D render brokerage services using his/her name with respect to the Plaintiff on August 22, 2012.

2. Whether the instant disposition is lawful

A. Plaintiff’s assertion 1) On August 22, 2012, the Plaintiff received contact with the lessor that his body was cut off and sent back to the hospital. Around that Do, the Plaintiff reported the case related to the lessee E from D, a brokerage assistant, and subsequently made the relevant documents, such as the copy of the register of the register, and ordered the Plaintiff to make the contract and obtain the seal. The Plaintiff transferred the lease contract made under the above circumstances from D to D, and then signed and sealed the lessor’s name from the lessor’s side, and then affixed the seal registered with the administrative agency. In light of the above circumstances, the Plaintiff cannot be deemed as acting as the broker, and thus, it does not constitute a case where the Plaintiff had the broker assistant use the Plaintiff’s name in the Plaintiff’s business, and thus, the Plaintiff’s disposition was unlawful as seen above.
