Reasons
Punishment of the crime
Defendant
A is the representative of Co., Ltd. in C at the time of harmony, and Defendant B is a corporation with the purpose of manufacturing motor vehicle parts.
1. Defendant A
(a) A person who intends to construct a container or a temporary building built of a container similar thereto which is to be used as a temporary warehouse or temporary lodging establishment of a temporary office shall commence the construction after filing a report thereon with the competent authorities;
However, on June 2014, the Defendant constructed a temporary building consisting of a part of the factory site B Co., Ltd. located in Hysung City Co., Ltd. (1st floor: 27 square meters in floor area, 28 square meters in floor area, 18 square meters in floor area) without reporting to the competent authority.
(b) A person who intends to construct or repair a building shall obtain permission from the competent authorities;
However, on June 2015, the Defendant extended the warehouse facilities (a total floor area: approximately 110.63 square meters) composed of prefabricated teams in the second floor of the general steel structure of the said corporation B without obtaining permission from the competent authority.
2. Defendant B Co., Ltd. committed the above violation in relation to the Defendant’s business at each time and place described in paragraph (1).
