The judgment of the court below is reversed.

The defendant is innocent. The summary of this judgment shall be notified publicly.

1. Summary of grounds for appeal;

A. The fact that the Defendant, who is aware of the fact, heard from I that he used KRW 300 million as the costs of lawsuit, and stated that he purchased the inspection.

B. The sentence of the lower court’s unfair sentencing (six months of imprisonment, one year of suspended sentence, one year of protection observation, and 80 hours of community service order) is too unreasonable.

2. In the instant facts charged at the trial from around March 2013 to May 2013, the prosecutor applied for amendments to the Bill of Amendment with the purport that “The part of the instant facts charged was “a temporary general meeting of shareholders from around May 2012 to around May 2013, while the part of the instant facts charged was “a temporary general meeting of shareholders and a non-place where shareholders and meals had been provided to shareholders in the vicinity of the Southern East-gu Police Station in Suwon-gu, Suwon-si, the Southern Police Station adjacent to the Southern Police Station in the Southern-si, the Southern Police Station in the Southern-si, and the Gyeong-si University in the Yongsan-si.” As such, the lower judgment was no longer maintained.

However, notwithstanding the above reasons for reversal of authority, the defendant's assertion of mistake of facts is still subject to the judgment of this court within the scope related to the changed facts charged, and this will be examined below.

3. Judgment on the Defendant’s assertion of mistake of facts

A. On January 15, 2014, the Defendant appeared as a witness of the Defendant’s defamation case against G, the court of Suwon District Court No. 308, which was located in Youngwon-dong 80, Youngwon-gu, Youngwon-dong, Suwon-si, 17:00 on January 15, 2014.
