The prosecutor's appeal is dismissed.

The gist of the reasons for appeal by the prosecutor is that the punishment imposed by the court below (eight months of imprisonment) is too uneasy and unfair, but in full view of the various circumstances that form the conditions for sentencing as indicated in this case, it is not recognized that the punishment imposed by the court below is too uneasy and unreasonable. Thus, the above argument is without merit.

Accordingly, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act.
