Defendant shall be punished by a fine of KRW 4,000,000.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

The Defendant is a person engaged in the business of selling precious metals under the trade name of Jongno-gu Seoul Metropolitan Government D.

1. On March 2, 2015, the Defendant purchased 4.71 money in 460,900 won owned by the Victim G, which he stolen from F in respect of the foregoing precious metal.

In such cases, the defendant engaged in the sales business of precious metals has a duty of care to verify whether he/she is stolen by ascertaining the F's personal information, etc., and by properly examining the details of acquisition of the money, the motive for sale, and the price suitable for the transaction price.

Nevertheless, the Defendant acquired the stolen goods by purchasing KRW 460,90, as a negligence, while neglecting the above duty of care and neglecting the determination on the stolen goods.

2. On March 3, 2015, the Defendant purchased KRW 26.5 money owned by F, such as the Victim H, which he stolen from F in the foregoing precious metal, 18 K 0.2 money, and 14 K 1.72 money, from KRW 5,631,50.

In such cases, the defendant engaged in the sales business of precious metals has a duty of care to verify whether he/she is stolen by ascertaining the F's personal information, etc., and by properly examining the details of acquisition of the money, the motive for sale, and the price suitable for the transaction price.

Nevertheless, the defendant acquired the stolen goods by purchasing the precious metal in KRW 5,631,50, as well as by negligence, unless he neglected the above duty of care and neglected to judge the stolen goods.

3. On March 10, 2015, the Defendant purchased the victim I’s net money of KRW 10,000, KRW 18K 6.72, and KRW 14K 13.65,00.

In such cases, the defendant engaged in the sales business of precious metals shall verify the F's personal information, etc., and shall verify whether the F's personal information is stated, and whether the details of acquisition of the money, motive for sale, and price suitable for the transaction prices are well examined.
