Reasons
1. Facts of recognition;
A. On August 29, 2017, the Plaintiff and the Defendant concluded a lease agreement with the Plaintiff stating that the Plaintiff shall pay KRW 5 million for the lease deposit, KRW 500,000 for the monthly rent, and KRW 500,000 for the lease term from September 1, 2017 to August 31, 2019, on condition that the Defendant, as the lessee, shall pay KRW 70,00 for the cleaning cost (hereinafter “instant lease agreement”).
B. Under the instant lease agreement, the Defendant paid KRW 5 million to the Plaintiff the lease deposit and occupied and used the instant real estate by taking over it.
C. However, the Defendant paid only up to October 2018 the rent to the Plaintiff, and did not pay the subsequent rent.
Accordingly, the Plaintiff expressed through the instant complaint that he/she would terminate the instant lease agreement on the grounds of the Defendant’s delay of rent, and the duplicate of the instant complaint containing such intent was served on the Defendant on June 10, 2019.

2. Determination
A. According to the above facts, on June 10, 2019, a copy of the complaint of this case containing the Plaintiff’s declaration of intent to terminate the instant lease agreement on the grounds of the Defendant’s delay of rent was delivered to the Defendant, and the instant lease agreement was lawfully terminated and terminated.

Therefore, the Defendant is obligated to deliver the instant real estate to the Plaintiff, and pay the sum of the monthly rent from November 1, 2018 to August 31, 2019, 500,000 won (50,000 won x 10 months) and 70,000 won for cleaning expenses, as unjust enrichment equivalent to delayed rent or rent.
B. The Plaintiff, in addition to the instant real estate, also leased and used the building D heading of the Yeongdeungpo-gu Seoul Building C for one month, and did not pay KRW 20,000 out of the rent, as well as management expenses, KRW 30,000, electricity taxes, etc.
