1. The Defendant shall pay to the Plaintiff KRW 32,00,000 and the interest rate of KRW 15% per annum from November 17, 2015 to the date of full payment.
Reasons
1. Basic facts
A. A. Around August 2008, the Defendant awarded a contract to the Dongyang Construction Industry Co., Ltd. (hereinafter “Dongyang Construction Industry”) and the same electric power building Co., Ltd. for the construction work of the 765km - the construction work of the 765km - the 32,810,347,90 won (around February 17, 2015, increased to 35,122,417,00 won) (around February 17, 2015, the said construction industry directly paid the subcontract amount to the 32,810,810,347,90 won (around June 2009, the 200,596,361,600 won, and the part of the “civil construction work” among the above construction work was directly paid to the 29,000,000 won, 296,000,000 won, and 296,010.
B. On the basis of an executory exemplification of the judgment with Seoul Central District Court 2012Gahap524002, the Plaintiff is entitled to “the construction cost claim of this case for which the obligor and the third obligor shall be paid by the Defendant as the Defendant.”
① On September 5, 2013, 2013, the Government District Court issued the order of seizure and collection with the amount claimed as KRW 215,650,898, which was KRW 215,650,898. The order of seizure and collection was served on the Defendant on September 11, 2013. ② on April 9, 2014, the Government District Court issued the order of seizure and collection with the amount claimed as KRW 239,43,519, with the amount claimed as KRW 239,43,512, and the order of seizure and collection was served on the Defendant on April 14, 2014, ③ the Government District Court issued the order of seizure and collection with the amount claimed as KRW 290,612,434 and won as KRW 2075, July 22, 2015, and received the order of seizure and collection to the Defendant on July 27, 2015.
However, on April 28, 2014, the Plaintiff withdrawn the application regarding the seizure and collection order of the above Government District Court 2013TTTT 2013TT 16587, and accordingly, the notice of cancellation of execution was served on the Defendant on May 2, 2014.
