A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

The defendant is the representative of D in the Young-gu Busan Metropolitan City, who employs 35 full-time workers and has them engage in marine facility manufacturing business.

[2015 Highest 1747] The Defendant was employed by the foregoing company on October 10, 2013 and worked as the head of the public service division, and was retired on December 29, 2014, the Defendant did not pay KRW 3,000,000 on August 29, 2014, wages of KRW 3,000,000 on September 20, 2014, wages of KRW 3,000,000 on October 20, 2014, wages of KRW 3,000,000 on November 1, 2014, and wages of KRW 2,806,451 and retirement allowances of KRW 3,587,780, total amount of KRW 18,394,231 on December 29, 2014, within 14 days from the date of retirement without agreement on the extension of the payment period.

In addition, the Defendant did not pay the total amount of KRW 212,465,867 of wages and retirement allowances of 44 workers within 14 days from the date of each retirement without agreement on extension of the due date, as stated in the attached Form “the statement of unpaid money and valuables by individual”.

[2015 Highest 3315] The Defendant did not pay KRW 3,437,723 of the retirement allowance of retired worker F from office in the aforementioned D from October 25, 201 to December 29, 2014, within 14 days from the date of retirement without any agreement between the parties on the extension of the due date, as stated in the “detailed statement of delayed payment” in the attached Form, such as where the Defendant did not pay KRW 17,382,048 in total for five workers’ wages and retirement allowances within 14 days from the date of retirement, without any agreement on the extension of the due date between the parties concerned.

[2015 Highest 4603] The Defendant served as an employee under the above D from January 1, 2014 to December 5, 2014, and did not pay 5,533,30 won of G wages of retired workers while working as an employee under the above D within 14 days from the date of retirement without an agreement on the extension of the due date between the parties concerned, and worked as described in the “the details of individual delinquent money and valuables” in the attached Table.

The retirement worker did not pay the total of 18,042,370 won within 14 days from the date of retirement without an agreement on the extension of the due date for payment between the parties concerned.
