A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

1. On April 4, 2012, at around 23:57, the Defendant: (a) called “a victim’s cell phone (D) using a phone number display line to which the victim C (the age of 22) uses; (b) obtained phone calls from the phone (D) using the phone number display line; and (c) confirmed that the victim is female, and thereafter, “the victim wants to promptly see as soon as possible”; and (d) made an obscene call to the victim 13 times in total as shown in the list of crimes in the attached Table 1.

Accordingly, the Defendant reached the victim with a view to meeting his own sexual desire, which causes a sense of sexual humiliation through the communication media.

2. On June 17, 2012, the Defendant, at around 06:44, sent phone (D) used by the victim E (n, 27 years of age) to the cell phone (D) where the phone number display is restricted, and confirmed that the victim is a female, and thereafter, “I want to promptly see the victim,” he/she issued a new voice with the victim,” and sent the victim’s obscene phone or sent obscene letters at a total of six times, as shown in the list of crimes in attached Table 2, until March 16, 2013.

Accordingly, the Defendant sent a sound or writing that causes a sense of sexual humiliation to the victim through communication media with a view to meeting his/her sexual desire.

3. On April 4, 2012, at around 22:13, the Defendant sent to the cell phone (G) used by the victim F (or 47 years of age) the word “I wish to be promptly seen” and sent the text and screen pictures of obscene content over 201 times from the time of transmission, etc. of video images with sexual intercourses between men and women, from January 10, 2013 to January 10, 2013.

Accordingly, the Defendant sent to the victim letters or videos that cause sexual humiliation through communication media with a view to meeting his/her sexual desire.

4. On March 10, 2013, the Defendant uses the victim H (n, 16 years of age) at an insular place around 00:10 on March 10, 201.
