Defendant D and E jointly set forth the Plaintiff KRW 100,000,100 and KRW 50,000,00 among them, from January 1, 2006.
Reasons
Basic Facts
The Plaintiff was registered as a shareholder in the financial statements as of December 31, 2003 of the Seoul Central District Court Decision 2010Hahap56 decided October 27, 201 (hereinafter “F”), and Defendant B was registered as a shareholder in the financial statements as of December 31, 2003 of the F, the representative director, Defendant C, and director as of April 30, 2002, and Defendant D were each employed as an auditor.
(A) On April 25, 2002, the Plaintiff entered into a joint agreement with Defendant C for the sales of a new officetel (hereinafter “instant joint agreement”) on April 25, 2002, and the main contents are as follows:
(A) Construction title 2. Construction title: The purpose of Article 1 (Purpose of Contracts) of the 688 square meters (2,275.00 square meters) and Article 1 (Purpose of Contracts) of the 688 square meters (referring to Defendant C) and “B (referring to the Plaintiff) shall be to perform the duties shared by each person through mutual consultation in order to facilitate the smooth implementation of the construction projects (offices and commercial buildings) being promoted on two parcels, including Suwon-gu K in Suwon-si, Suwon-si.
Article 2 (Scope of Duties) "A" shall be "B" and joint implementers, and shall faithfully perform the duties of the following subparagraphs.
- The work arising from the purchase of land for the work of “A” - the selection (design office, sales agency, judicial scrivener, etc.) of the joint related enterprise “B” and the management of proceeds from the conclusion of contracts for sale - the settlement and selection of joint occupants “A”, “B” and “B” - the work arising from the joint project progress - the balance of land for the procurement of “A”, “B” and “B” - the work arising from the purchase of land for the work of “A”, “B” and “B” - the joint related enterprise’s selection of “A”, “B” and “B” - the management of proceeds from the conclusion of contracts;
