A은 부산 중구 H에 있는 ‘I 게임 랜드’ 의 업주이고, 피고인 B, 피고인 C은 위 게임 장에서 손님들에게 똑딱이를 올려 주고, IC 카드를 지급하는 종업원이며, 피고인 D은 속칭 ' 문 빵 '으로 위 게임 장 앞에서 경찰 단속에 대비하는 한편 손님들에게 환전 상의 위치를 알려주는 종업원이며, 피고인 E은 환전상이다.

On November 2016, the Defendants installed a game machine which was remodeled to enhance the speculation of the above game site, let customers play the game, and conspired to exchange the game to customers who finished the game.

A은 2016. 11. 14. 경부터 2017. 1. 17.까지 위 게임 장 내에 ‘ 바보 삼 형제’ 게임 기 60대를 설치하고, 2017. 1. 18.부터 2017. 3. 20. 경까지 위 게임 장 내에 게임 물관리 위원회로부터 등급 분류 받은 내용과 달리 외부기기를 이용하여 게임 점수를 마음대로 삭제할 수 있도록 개조한 ' 심해 속으로 (Deep seA)' 게임 기 60대를 설치하였으며, 피고인 B, 피고인 C은 그 곳을 찾은 불특정 다수의 손님들에게 게임기용 IC 카드를 지급하고 손님들이 지정한 게임기 위에 속칭 ` 똑딱이` 로 불리는 자동 진행장치를 사용하여 손님들이 게임을 하도록 하고, 피고인 D은 게임 장 밖에서 망을 보다가 게임을 끝낸 손님들을 환전 상인 피고인 E에게 안내하고, 피고인 E은 손님의 IC 카드에 저장된 게임 점수를 확인하여 게임 점수 1점 당 4,500원으로 계산하여 현금으로 환전해 주었다.
