1. The Plaintiff:
A. As to Defendant B’s KRW 358,262,397 and KRW 125,796,00 among them, Defendant B shall be from January 1, 2013 to July 14, 2016.
Reasons
1. Basic facts
A. 1) The Plaintiff newly built Jung-gu E apartment (hereinafter “instant apartment”) in Jung-gu, Incheon.
As to the Defendants, the sales contract in question (hereinafter “instant sales contract”) with the Defendants as follows.
(1) According to each of the sales contracts of this case, the sales contract of this case was concluded on March 16, 2010, the sales contract of this case 1 B B 106 and 503 28,180,000 on March 16, 2010 and 231,540,000 on February 331, 208, 2000 on February 331, 2010, 200 117,030,030, 3400 3D 102, 2401, 331,540,000 on November 4, 2009 and 31,540,000,000,610,0000,000 on March 16, 2010.
Each sales contract of this case stipulates the interest rate on delay when the buyer delays the payment of the intermediate payment and the balance as follows:
(Article 5(2). A) The contract entered into. The remainder of the option construction cost should be paid on the date for designation of occupancy as determined by the Plaintiff, and Article 5 of the sales contract of this case shall apply mutatis mutandis to the overdue interest rate at the time when the Defendants delayed any remainder. B. In the instant sales contract where the Plaintiff’s intermediate payment loan was arranged, ① the Plaintiff arranged the buyer to receive the intermediate payment loan, and agreed to pay in advance the interest on the intermediate payment on the condition of subsequent settlement until the date of use inspection, and ② the buyer thereafter interest.
