A defendant shall be punished by imprisonment for not less than two years and six months.

The defendant shall complete the sexual assault treatment program for 40 hours.

Punishment of the crime

The defendant and the victim M(M, 16 years of age) are in school and have lived together in the defendant's residence.

1. On January 2018, the Defendant violated the Act on the Protection of Children and Juveniles against Sexual Abuse (Indecent Act by compulsion) made the victim’s chest by inserting his/her fingers into the victim’s body in the Defendant’s dwelling plan of the Defendant N in Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-do, 2018. The Defendant forced the victim’s chests by giving more force to the Defendant’s hand, despite his/her refusal to take the Defendant’s hand away.

As a result, the defendant committed an indecent act against a child or juvenile victim by force.

2. Violation of the Act on the Protection of Children and Juveniles against Sexual Abuse;

A. At early 03:00 on March 2018, the Defendant called “I would like to do so once” to the victim at the same place as indicated in the above 1.1., but the victim, despite being refused to do so, was forced to do so by the victim, and even though he refused to do so, the victim was forced to go off the victim’s body and her body, and forced the victim’s body to tightly and resist the victim’s body, and led to sexual intercourse.

B. Around 01:00 to 03:00 on the early April 2018, the Defendant called “I would like to have a sexual intercourse” to the victim at the same place as indicated in the foregoing paragraph 1. However, the victim, even though the victim refused, “I would like to have a sexual intercourse,” referring to “I would like to have a sexual intercourse,” and “I would like to have a sexual intercourse.” However, the victim was forced to go off the victim’s body by force, and forced the victim’s body, pushed down the Defendant’s body, and forced the victim’s resistance.

C. At around 03:00 to 04:00 on April 2018, the Defendant told the victim to “I wish to have a sexual intercourse” at the same place as indicated in the foregoing paragraph 1. However, the victim “I do not want to have a sexual intercourse,” and even though the victim refused to do so, Da Da son was forced to leave the victim’s lower part.
