A defendant shall be punished by imprisonment for not less than one year and six months.

Seized evidence 2 or 3 shall be confiscated.

The defendant shall file an application with B for compensation.

Punishment of the crime

The organization of telecommunications fraud (hereinafter referred to as “scams”) is operated in the form of an organization by organizing various stages of steps, such as total books, incentives, management measures, and cash delivery measures. An employee under the incentive scheme assumes false statements by phone calls from many unspecified victims, such as “in order to confirm whether or not the victim’s personal information has been stolen, to withdraw cash and deliver cash to the Financial Services Commission,” thereby inducing victims to withdraw cash and deliver cash delivery books. The cash delivery scheme is carrying out a criminal act according to each person’s role, such as: (a) making the victim’s response to the civil petition under the name of the Financial Services Commission; (b) sending cash to the account designated by the management measures, etc. upon receipt of the funds.”

On September 2019, the Defendant: (a) heard the phrase “C,” posted by the Organization of Telecommunications-based Financial Fraud (hereinafter “Sphishing”); (b) sought an advertisement that “C,” “D,” “E,” etc., through Kakakaox; (c) made it possible for the Defendant to deposit money from the Kakaoxing staff to receive the balance of the accidents involving virtual currencies, coaches, etc.; and (d) made it possible for the Defendant to deposit money, as such, to receive money from the victims; and (c) received money from the victims by means of a false document under the name of the Financial Services Commission; and (d) consented to transfer money from the victims to the account designated by the Kakaox to receive daily allowances.”

1. On October 1, 2019, the Defendant forged public document documents in the PC room located in the Gyeonggi-do Office at the time of the Gyeonggi-do, and via Kakakaoox from the said Bosing staff “D” to the said Bosing staff (No. 2019- type No. -4554).
