피고인은 2015. 9. 30. 12:45 경 대구 동구 C에 있는 피해자 D(51 세) 가 관리하는 E 내 공터에서 피해자와 공터 사용 문제로 시비가 붙어 말다툼을 하다가 손으로 피해자의 목과 턱 부위를 수회 때리고, 위험한 물건인 끝이 뾰족 한 렌치를 들고 피해자를 때릴 듯이 위협하는 등 피해자를 폭행하였다.
