Reasons
Punishment of the crime
Defendant
A is the chief of the D dispute, Defendant B is the office chief of the E branch, and Defendant C is the F Committee’s labor movement.
The Defendants decided to install and distribute advertising materials and printed materials with the aim to put pressure into H candidates, who were frighted in the election of the 19th National Assembly members of the Republic of Korea, in relation to the result of the Gmm wave conducted from around December 8, 2010, with the aim of bringing pressure into the H candidates who were fright in the 19th National Assembly election.
1. No person who is a defendant A shall install any name of a political party or the name or photograph of a candidate, or any banner or other advertisement showing the contents by which such name or name may be inferred, in order to influence an election from 180 days before the election day to the election day;
On March 19, 2012, the Defendant installed, in front of the Jongno-gu Seoul Jongno-gu Seoul J building, a banner indicating the political party and candidate’s name, “G long-term strike resolution Dil-dong” on the roads of the Jongno-gu Seoul J building, and installed advertisements in the form of banner and feeet as shown in the attached list 1 of the crime sight.
Accordingly, in order to influence the election, the defendant set up a banner and other advertisements that refer to I or H candidates or include contents that can be inferred.
2. Defendants shall not install the name of a political party or candidate, or install a banner or other advertisement with the name of a political party or candidate, or with such name and photograph, or with such contents as may be inferred from such name, in order to influence the election, from 180 days before the election day to the election day, or wear or distribute a label or other indication, include matters supporting, recommending or opposing a political party or candidate, or distribute any printed materials indicating the name of a political party or candidate's name, and in order to have an influence on the election during the election period;
