Of the judgment of the court of first instance, the Defendants’ failure in excess of the amount ordered to be paid under the following subparagraphs shall be revoked.

1. Basic facts

A. On April 18, 2017, the land was divided into D 2,487 square meters prior to the division that was owned by the Defendant C, on the following occasions: D 581 square meters on April 18, 2017; J 581 square meters; L 581 square meters, N 581 square meters, AC 163 square meters (hereinafter referred to as “the land after the division”). B. Since then, the Defendants and E (hereinafter collectively referred to as “the Defendants, etc.”) who owned the said land as indicated in the table below, concluded a contract for construction of each multi-family house with O and each multi-family house (hereinafter referred to as “construction”) for the purpose of constructing the said building, as well as H, K, M, I Dong (hereinafter referred to as “H Dong”), which is a multi-family house, on the ground as indicated below, while promoting construction of the G building, which is a multi-family house.

On May 21, 2018, the Defendants, etc. concluded a temporary material lease agreement with the Plaintiff for the construction of steel reinforced concrete during the instant construction work (hereinafter “instant lease agreement”).

The main contents of the instant lease agreement and the form in which the Defendants, etc. affix their signatures or seals to the said contract is as follows.

◆ 임대방식: 일괄 임대차( 금 회지 정형), 가설 자재를 면적 단위로 환산하여 일괄적으로 임대하는 방식으로, 공정에 따라 순차적으로 출고( 인도), 입고( 반환) 하고, 임대차 장소와 공 종을 특정하여 계약한다.
