1. The plaintiff's claim is dismissed.

1. Basic facts

A. On September 21, 2018, the Plaintiff, as the Defendant’s member, entered into a supply contract (hereinafter “instant contract”) with the Defendant, the implementer, the seller, the Defendant, and D Co., Ltd. for the supply of the Mapo-gu Seoul E Ground F (hereinafter “instant apartment”).

B. According to the contract of this case, the management and disposal price of the apartment of this case is 615,100,000 won, and the Plaintiff’s member’s member’s right is 991,038,757 won exceeding the above sale price, and the Plaintiff is entitled to refund KRW 375,938,757, and the share payment amount is stated as follows.

The amount to be paid in installments shall be KRW 2018-01-22 -37,593,00, and KRW 2018-22-37,593,00, and KRW 2018-6-20,37,593,00 for the second 2018-11-20-37,593,000 for the third 2018-42-22-37,593,000 for the fourth 2019-4-22-37,593,000 for the second 2019-210-21,37,593,000 for the second 6th 2020-037,593,000 for the remainder of occupancy -12,787,757,787,375,79, and 375 of the intermediate payment to be paid in installments (hereinafter the same shall apply).

(2) A household to whom a refund is made shall be refunded from A within 21 days (the next business day if a holiday is a holiday) from the due date for the payment of the members' apartment, the down payment and the intermediate payment, and the remainder, on the account number entered in a copy of the passbook in the name of the union member.

However, the above payment period may be adjusted by A according to the payment schedule of the general sale price.

(hereinafter referred to as "the balance") shall be paid within the due date for payment that A subsequently designates and notifies.

Article 5 (Additional Fees, Overdue Charges, and Compensation for Delay) (1) In cases where A pays B an intermediate payment and any balance before the agreed date, A shall pay it by 3% per annum for the advance payment amount.
