1. The Defendants are jointly and severally and severally liable to the Plaintiff for KRW 17,972,621 and KRW 1,930,131 among these costs.
Reasons
1. Facts of recognition;
A. On June 11, 2007, the Plaintiff entered into an agreement with Defendant A Co., Ltd. (hereinafter “Defendant Co., Ltd.”) to lend the loan amount of KRW 3,750,000,000,000, and received the loan amount of KRW 1,000,000,000. ② On March 12, 2009, the Plaintiff entered into an agreement to lend the loan amount of KRW 1,000,000,000; ③ on September 7, 2006, the Plaintiff entered into an agreement to guarantee foreign currency payment with the limit of KRW 1,50,00,000. ④ On January 16, 2007, the Plaintiff concluded an agreement to guarantee foreign currency payment with the limit of KRW 3
(hereinafter referred to as "loans Nos. 1, 2, 3, and 4 of this case" in the order of each subparagraph.
Defendant B jointly and severally guaranteed the Defendant Company’s obligations arising from the loans Nos. 1, 3, and 4 of this case against the Plaintiff. Defendant C jointly and severally guaranteed the Defendant Company’s obligations arising from the loans No. 1 of this case to the Plaintiff within the limit of KRW 1.2 billion, up to KRW 2,833,200,000 (US$ 2.4 million on December 17, 2015, US$ 1180,50.50 on December 17, 2015). Defendant D jointly and severally guaranteed the Defendant Company’s obligations arising from the loans No. 1 of this case to the Plaintiff within the limit of KRW 5.40,00,00,000 on the loans No. 3 of this case, and the obligations arising from the loans No. 4 of this case within the limit of KRW 4,249,80,000 on the loans No. 5,500,000 on the loans No. 1 of this case. 2.
C. Each of the instant loans remains worth KRW 2,585,197,013 as of December 15, 2015, and KRW 2,695,505,806 as of December 15, 2015.
