The judgment of the court below is reversed.

The defendant is innocent. The summary of this judgment shall be notified publicly.

1. Summary of grounds for appeal;

가. 사실오인 내지 법리오해 1) 이 사건 공소사실 기재와 달리 피고인이 F으로부터 고춧가루를 구입한 것이 아니고, 피고인이 구입한 고추를 F에게 방앗삯을 주고 빻아 달라고 한 것에 불과하다. 2) 설령 그렇지 않다고 하더라도, ‘즉석판매제조ㆍ가공업자’인 F이 고춧가루를 자신의 업소 내에서 최종소비자인 피고인에게 판매한 것이어서 이는 식품위생법상 적법한 것이므로, 피고인이 위 고춧가루를 구입하여 김치를 제조하는데 사용하였다고 하여 영업자가 아닌 자가 제조ㆍ가공한 고춧가루를 판매할 목적으로 사용한 것이라고 할 수 없다.

B. The sentence imposed by the lower court on the Defendant (six months of imprisonment and two years of suspended execution) is too unreasonable.

2. Judgment on misconception of facts or misapprehension of legal principles

(a) No person who is not a business operator shall sell foods, etc. manufactured, processed, subdivided or subdivided by persons other than business operators, or collect, manufacture, import, process, use, cook, store, subdivide, transport or display such foods, etc. for sale;

Nevertheless, from January 2013 to May 13, 2013, the Defendant used to create kimchi by purchasing red molds powder equivalent to KRW 191,488,00 in total at the market price from E companies operated by the Defendant in Bupyeong-gu Incheon, Incheon, and from F operating a manufacturing and processing company of non-registered foods, and from F operating a manufacturing and processing company of non-registered foods.

Accordingly, the defendant used them for the purpose of selling molds manufactured and processed by a person who is not a business operator.

B. According to the evidence submitted by the lower court’s determination, F, which was operated with the signboard “H”, is merely a spot-sale manufacturer or processor, and can only sell them directly to the end-consumers within one’s own business place without registration of food manufacturing and processing business, and the Defendant, not the end-consumers, may not sell the molds powder as indicated in the judgment of the lower court.
