1. A person who intends to conduct business prescribed by Presidential Decree which generates fugitive dust shall report to the head of a Special Self-Governing Province branch office, the head of a Si/Gun/Gu, and install facilities to control fugitive dust or take necessary measures, as prescribed by Ordinance of the Ministry of Environment;

Nevertheless, on November 2, 2015, when the Defendant carried out the work of transporting and crushing wastes from the construction site B at the above company B, the Defendant installed automatic facilities and carried out necessary measures without using them when the transport vehicle enters and enters the above business site.
